An anonymous Trump administration official stated that the administration will challenge the recent D.C. Circuit Court of Appeals decision denying the administration’s request for a stay pending appeal in the case of Federal Reserve Governor Lisa Cook. That decision allowed Ms. Cook to remain on the job and participate in this week’s Federal Open Market Committee meeting. (NYT.)
President Trump on Tuesday disclosed that U.S. forces have “knocked off” another alleged drug-smuggling boat from Venezuela. According to the President, the U.S. has now struck three boats carrying alleged drug smugglers from Venezuela. (WaPo.)
In a report filed to Congress, a whistle-blower claimed that at least 30 children cleared by the Trump administration for imminent removal to Guatemala bore “indicators of being a victim of child abuse,” and thus should have been ineligible for deportation. The claims appear to contradict a sworn statement made by a senior administration official. (NYT.)
Attorney General Bondi faced widespread criticism for announcing that the Justice Department would “absolutely target” protesters engaging in “hate speech” following the murder of Charlie Kirk. (NYT.) Conor Friedersdorf argues that if AG Bondi follows through on her comments, “she would deserve to be impeached.” (The Atlantic.)
Pending Interim Order Applications Involving the U.S. Government in the Supreme Court
Department of State v. AIDS Vaccine Advocacy Coalition: The government filed an emergency application on September 8 requesting the Supreme Court partially stay a district court injunction ordering the Trump administration to spend $4 billion in funds by September 30. The Supreme Court granted the government’s request for a partial stay pending further order of the Court and ordered a response to the government’s application on or before September 12. Respondents Global Health Council, et al. filed a response on September 12, and the Department of State, et al. filed a reply on September 15th.
Trump v. Slaughter: The government filed an emergency application on September 4 requesting the Supreme Court stay a district court decision to allow the firing of FTC Commissioner Rebecca Slaughter to proceed. The Supreme Court granted the government’s request for an administrative stay and ordered a response to the government’s application on or before September 15th. Rebecca Slaughter, et al. filed a response on September 15th, and Donald Trump, et al. filed a reply in support of the application for a stay on September 16th.
