Judge Emmet G. Sullivan (D.D.C.) barred the U.S. Postal Service from imposing restrictions on mail-in ballots, finding the restrictions violated the terms of a 2021 settlement agreement between USPS and the NAACP. (Memorandum Opinion.) (NYT.)
Judge Robert E. Payne (E.D. Va.) preliminarily enjoined a Virginia statute banning state and federal law enforcement officers from wearing facial coverings while performing their official duties. The judge held that the statute’s direct regulation of “the conduct of federal law enforcement in the enforcement of the federal immigration laws” violated the intergovernmental immunity doctrine and the Supremacy Clause. Former CIA Director John Brennan sued the Justice Department in the District of Columbia on Wednesday, seeking an injunction requiring the department to preserve its internal records and communications regarding its decisions to investigate and potentially prosecute Brennan. (Complaint.) (WaPo.)
